Florida’s New Hurricane Protection Law for HOAs

Last May, Governor DeSantis signed a new bill, HB 293, that requires Florida HOA boards to adopt hurricane protection specifications that meet the building code regulations for all the buildings in its community. The bill specifies that hurricane protections include “roof systems recognized by the Florida Building Code which meet ASCE 7-22 standards, permanent fixed storm shutters, roll-down track storm shutters, impact-resistant windows and doors, polycarbonate panels, reinforced garage doors, erosion controls, exterior fixed generators, fuel storage tanks, and other hurricane protection products used to preserve and protect the structures or improvements on a parcel…[1]

The bill gives HOAs the authority to set aesthetic standards for the hurricane protection, such as requiring homeowners to comply with a set color scheme, style, or other aesthetic factors that the board decides. Notably though, HOAs no longer have the ability to deny a homeowner’s application for the “installation, enhancement, or replacement of[2]” hurricane protections, provided they meet the aesthetic guidelines established by the HOA. This bill helps ensure that all homeowners living in HOAs throughout Florida have the right to fortify their homes against hurricanes.
