New Hurricane Protections for Condo Residents

This past summer, Florida’s HB 1021 took effect, impacting condo associations and residents in Palm Beach, Broward, and Miami-Dade counties, as well as all other areas throughout the state. This sweeping bill affects multiple aspects of condo management, including requirements about hurricane protection.

The aim of the hurricane protection portion of the bill is to improve the safety of condo residents during these powerful storms. The bill defines hurricane protection as “hurricane shutters, impact glass, code-compliant windows or doors, and other code-compliant hurricane protection products used to preserve and protect the condominium property or association property.[1]” Prior to this bill, Florida lacked a consistent definition of “hurricane protection” in its laws and between different condo associations.

The bill requires that each condo association specify whether the unit owner or the association will be responsible for the “installation, maintenance, repair, or replacement of hurricane protection[2]” in the condo units. If the condo association votes that the unit owners are responsible for this cost, and a unit owner does not comply with the required hurricane protection, the association can install or repair the hurricane protection for them and then issue the unit owner a special assessment to cover the cost that the association incurred.

The bill further states that if the condo association must remove and reinstall hurricane protections to perform building maintenance, the association is responsible for the costs incurred for the removal and reinstallation.
